Fenceit LLC, a limited liability company organized and existing under the laws of the State of Texas, having its principal place of business at 2807 Allen St #2048, Dallas, TX 75204, hereinafter referred to as "Fenceit," can be contacted at phone number (972) 755-9086.
Fenceit provides estimations and full-service fence installations. The customer may select the installation date. Fenceit reserves the absolute right to adjust the installation date based on material availability, installer scheduling, inclement weather, or acts of God. Fenceit retains sole discretion in selecting and changing brands for the installation, without any liability to the client.
Upon entering into an agreement, the client shall remit a non-refundable deposit of $500. The remaining balance shall be paid in full one day prior to the scheduled shipment of materials. The total installation cost, clearly stated upfront, is non-negotiable. Fenceit shall not entertain any change orders after the agreement is finalized.
The client may cancel the agreement up until the day preceding the material shipment, upon which Fenceit shall retain the $500 security deposit. In the event of cancellation, Fenceit is entitled to retain the deposit as liquidated damages, and the client waives any further claim to the deposit or any additional costs.
Fenceit provides a limited 12-month workmanship and material warranty, which is transferable and shall convey with the sale of the property to a new owner. This warranty covers both the workmanship and the materials used in the installation. Any claim under this warranty must be made in writing to Fenceit within the warranty period and will be limited to repair or replacement of the defective work or materials at Fenceit's discretion.
Fenceit maintains a workman's compensation and general liability policy of $1,000,000. Fenceit shall be held liable only for damages directly and intentionally caused by its installers. Fenceit assumes no responsibility for the loss or damage of plants, trees, or other landscaping elements as a result of the installation.
It is the sole responsibility of the client to carefully select desired options, timely make payments, provide unimpeded access to the installation site, and leave a review following the completion of the installation.
In the event of any dispute arising out of or in connection with this agreement, the parties shall first attempt to resolve the dispute through amicable negotiations. If the dispute cannot be resolved through negotiation, the parties agree to submit the matter to mediation before resorting to legal action. If mediation fails to resolve the dispute, either party may initiate legal proceedings, and the prevailing party shall be entitled to recover all reasonable attorney's fees and costs incurred in such proceedings.
